Terms and Conditions of Use for HRzilla

Welcome to HRzilla! These Terms and Conditions of Use ("Terms") govern your use of HRzilla’s SaaS platform, including any AI-powered features that assist in candidate matching and recruitment processes. By accessing or using the HRzilla platform, you ("User") agree to comply with and be bound by the following Terms.

1. Service Description

HRzilla provides an AI-powered platform that evaluates candidate CVs against job descriptions provided by the User. The platform delivers a relevancy score and an explanation of the score for each candidate, aiding in recruitment decision-making.

Important: HRzilla does not store CVs, make final recruitment decisions, or engage in any employment-related actions. The ultimate hiring decision is the sole responsibility of the User.

2. Use of Services

You agree to use HRzilla's services only for lawful purposes and in accordance with these Terms & Conditions. You are prohibited from violating or attempting to violate the security of the Service.

3. Intellectual Property

The content, organization, graphics, design, and other matters related to HRzilla are protected under applicable copyrights and other proprietary laws. The copying, redistribution, use or publication of any such matters or any part of the Service is prohibited.

4. User Responsibilities

4.1 Data Control and Consent

The User is solely responsible for collecting and processing any personal data, including candidate CVs, uploaded to the platform. This includes, but is not limited to:

  • Obtaining necessary consents from candidates for the processing of their data via HRzilla’s AI system.
  • Ensuring compliance with all applicable data protection regulations (e.g., GDPR, CCPA) as the data controller. HRzilla operates as a data processor only in accordance with the User’s instructions.

4.2 Accuracy of Job Descriptions and Data

The User is responsible for the accuracy, completeness, and legality of all job descriptions, candidate data, and other materials provided to HRzilla. HRzilla disclaims any liability for errors, omissions, or inaccuracies in data provided by the User.

4.3 Supervision and Final Decisions

HRzilla’s AI provides an automated evaluation of CVs but does not make final hiring decisions. The User is solely responsible for reviewing AI-generated outputs and making any hiring or employment decisions. HRzilla assumes no liability for any decisions or actions based on AI outputs.

5. Data Protection and Security

5.1 Data Processor Role

HRzilla processes candidate data on behalf of the User strictly for the purpose of providing the service. HRzilla does not store CVs or retain personal data beyond the duration necessary to complete the evaluation.

5.2 Security Measures

HRzilla implements reasonable security measures to protect data processed through its platform. However, the User is responsible for ensuring their own secure methods of data transmission and ensuring compliance with any relevant security regulations.

6. Non-Discrimination and Compliance

6.1 AI Outputs and Non-Discrimination

HRzilla’s AI does not use sensitive attributes such as race, gender, age, or religion to evaluate candidates. However, the User is responsible for ensuring that their use of the platform complies with all anti-discrimination laws applicable to their hiring practices. HRzilla cannot be held liable for discriminatory outcomes stemming from the User’s recruitment processes.

6.2 Compliance with Applicable Laws

The User agrees to comply with all local, national, and international laws and regulations applicable to its use of HRzilla’s platform, including but not limited to labor, employment, and data protection laws.

7. Limitations of Liability

7.1 AI System Limitations

While HRzilla strives to ensure the accuracy and reliability of its AI system, the platform is provided "as is", and HRzilla makes no representations or warranties regarding the accuracy, completeness, or fitness for purpose of any AI-generated outputs.

7.2 No Responsibility for Hiring Decisions

HRzilla disclaims all liability for decisions made by the User based on AI-generated outputs. The User assumes full responsibility for verifying and evaluating the AI results before taking any employment action.

8. Indemnification

The User agrees to indemnify, defend, and hold harmless HRzilla and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from the User’s use of the platform, including but not limited to:

  • Non-compliance with data protection regulations.
  • Discriminatory hiring practices.
  • Any hiring decisions made based on AI outputs.

9. Termination

HRzilla reserves the right to suspend or terminate access to the platform if the User fails to comply with these Terms or if HRzilla reasonably believes that the User’s use of the platform violates any applicable laws or regulations.

10. Amendments

HRzilla reserves the right to modify these Terms at any time. Continued use of the platform after such modifications constitutes acceptance of the revised Terms.
